The StadiumGO Carpooling Platform, and all the services offered on it, are based on compliance with all the rules defined below, in these General Terms of Use.

Preamble

The company StadiumGO SAS (hereinafter referred to as "StadiumGO"), establishes and manages a Platform, accessible on a website, in particular at www.stadiumgo.fr, or in the form of a mobile application, designed to organise joint Carpooling journeys for the purpose of travelling to a sporting event, all through the online posting of propositions between private individuals, posted by drivers making the Journey on their own behalf.

The purpose of these General Terms of Use (hereinafter referred to as the "GTU") is to govern access to and use of the Services. It is imperative that all Users visiting the Platform take full cognizance of these Terms of Use.

Consequently, by registering on the Platform, you acknowledge that you have read and accepted these Terms of Use in their entirety. StadiumGO has no contractual relationship whatsoever with any member of the Platform.

1. Definitions of terms

For the purposes of understanding and reading these General Terms of Use, the following terms are defined as follows:

"Proposition": refers to a Carpooling Propositions posted on the Platform as part of a Trip made by a Driver;

"GTU": refers to these General Terms of Use;

"Account": refers to the account that must be created on the Platform in order to become a Member and benefit from certain services, in particular the publication of Carpooling Propositions and Reservations;

"Connected Account": refers to the account associated with each Member, automatically created by Stripe, and whose purpose is to enable the Member to manage his or her financial transactions on the Platform, in particular to request the transfer to his or her bank account of amounts due to him or her;

 "Driver": refers to the Member who offers to transport one or more natural persons in return for the Contribution to Costs, by means of an Proposition posted on the Platform;

"Reservation Confirmation": refers to the summary e-mail received by the Passenger who has made a Reservation, containing all the terms and conditions relating to the Trip;

"Contribution to Expenses" means the amount requested by the Driver from each Passenger on a Carpooling Trip, as part of their contribution to the travel expenses relating to the Trip;

“Carpooling": refers to the joint use of a motorised land vehicle by a non-professional driver and one or more adult passengers, for a Trip for personal purposes, who share only the corresponding costs (gas, tolls, etc.); "Carpool": refers to the use of a motorised land vehicle by a non-professional driver and one or more adult passengers, for a Trip for personal purposes, who share only the corresponding costs (gas, tolls, etc.).

"Sporting and Cultural Event" means a sporting and cultural events taking place in a defined and supervised public place;

"Reservation Fee" has the meaning given to it in article 5.2 below;

"Member": refers to any natural person who has created an Account on the Platform;

"Messaging": refers to the messaging system available on the Platform, through which Members can communicate with each other;

"Passenger": refers to the Member who accepts a Driver's offer to transport him or her, by means of an Proposition to which he or she has replied, and for which he or she undertakes to contribute to the costs incurred by the Trip;

"Seat" means the seat reserved by a Passenger on board a Driver's vehicle;

"Platform" has the meaning given to it in the Preamble, above;

"Profile" refers to the personal space where a Member can consult and modify, if necessary, his/her personal information;

"Reservation" refers to the action of reserving one or more places on a Driver's Trip, with a view to making the said Trip together;

"Sections" refers to all the sections available in each Member's Profile;

"Services" refers to all the services offered by StadiumGO on the Platform, in particular the publication of Classified Propositions and Seat Reservations;

"Site" refers to the Carpooling Tomorrowland Winter website available at the following address: https://carpooling.tomorrowlandwinter.com ;

"StadiumGO" has the meaning given to it in the Preamble above;

"Stripe" refers to the payment service used throughout the Platform;

 "Trip" refers to the journey corresponding to a Carpooling Proposition published by a Driver on the Platform, and for which he agrees to transport Passengers in return for a Contribution to Costs;

"User" refers to any natural person visiting and using the Platform without having created an account;

2. Terms and conditions of registration for the Service

To register on the Platform, you must meet all of the following conditions:

  • Be at least 18 years of age on the day of registration;
  • Read and accept these Terms and Conditions of Use, by checking a box that reads "I accept the Terms and Conditions of Use";
  • Create an account, as described in article 3.1 below;

Any registration by a minor is therefore strictly forbidden. By registering or using the Platform, you warrant that you are 18 years of age or older.

2.1. Platform registration conditions

To register on the Platform, you must fill in all the mandatory fields on the registration form, available on the Site. To validate your registration, you must have read and accepted these GTU. You will also receive, by e-mail to the address indicated during registration, a link to validate your Account, which will then become active.

2.2 Creating a Member account

Becoming a Member means filling in the registration form and validating your account, as indicated in article 2.1. You are then able to use all the Platform's Services, i.e. :

  • Publish and consult Carpooling Propositions;
  • Exchange with other Members to agree on the terms and conditions of a Carpooling Trip;
  • Book one or more Seats on a Journey;

Viewing Classified Proposition is possible without registering on the Platform.

When creating your Account, in particular by using the registration form, you undertake to provide accurate and truthful personal information, and to modify it, if necessary, via your Profile. If you have any difficulty in modifying any of the information in your Profile, it is your responsibility to contact us at contact@stadiumgo.fr in order to inform us.

Once registered, you undertake to keep secret the password defined when creating your Account, and not to disclose it under any circumstances. In the event of loss or disclosure of the said password, you undertake to inform us as soon as possible. Otherwise, StadiumGO will hold you solely responsible for any use made of your Account by a third party.

You agree not to create or use, under any identity whatsoever, other Accounts on the one created at the time of your registration.

2.3. Verification of personal data

For legal or security reasons, StadiumGO may ask you, at any time, to provide one or several documents that may be used to verify the accuracy of the information you provided when registering.

2.4. Account deletion or suspension

In the event that your Account, for any reason whatsoever, is the subject of complaints or reports, or does not comply with these GTU, StadiumGO reserves the right, at its sole discretion, to delete or suspend your Account without notice.

3. Use of the Services

3.1 Publishing a Carpooling Proposition

As a Member of the Platform, you may publish Carpooling Propositions on the Platform by providing the necessary information relating to the Trip concerned (sporting event concerned, dates, times, departure point, number of seats offered, amount of the Contribution to Costs, etc.).

However, to publish a Carpooling Proposition on the Platform, you must meet all of the following conditions:

  • Travel to a sporting or cultural event that you have selected in advance on the Platform and for which you wish to post a Carpooling Proposition;
  • Hold a valid driver's licence;
  • Post Carpooling Proposition that relate solely to your personal vehicle, or the one you are using for the Trip, having, where applicable, an authorization from the owner attesting that you are authorised to use said vehicle for Carpooling purposes;
  • Have valid third-party insurance for your vehicle or the one used for the Trip;
  • Use a vehicle that is in perfect working order and complies with all applicable customs and legal provisions, including an up-to-date technical inspection;
  • Use a vehicle that meets the following criteria: a 4-wheeled passenger car with a maximum of 7 seats, with the exception of "no-licence" vehicles;
  • Have no medical contraindications to driving;
  • Not to offer more Seats than are available in your vehicle, or the one used for the Trip;
  • Guarantee that all Seats offered in the Proposition are equipped with a seatbelt;

When completing the Carpool Proposition form, it is expressly stated that you may not choose a different place of arrival from the one initially planned by the Platform, i.e. the location of the Sports and Cultural Event to which you wish to travel and for which you have previously added a Carpool Proposition on the Platform.

It is therefore naturally forbidden to attempt, by any means whatsoever, to add a "classic" Carpooling Proposition that does not correspond to a Journey with the aim of getting to a Sports and Cultural Event.

You acknowledge that you are solely responsible for the content of the Carpooling Proposition published on the Platform. Furthermore, you guarantee the accuracy and truthfulness of all information contained in this Carpooling Proposition, for which you undertake to carry out the Trip according to the terms and conditions described therein.

By publishing your Carpooling Proposition, you make it visible to Members and non-Members searching on the Platform. StadiumGO reserves the right not to publish or, if necessary, to remove any Carpooling Proposition that does not comply with these GTU.

You are also hereby informed of the penalties provided for in Article L.132-2 of the French Consumer Code, in the event that you use the Platform on a professional basis. In the event of a breach of this rule, StadiumGO reserves the right to permanently delete your Account.

3.2 How to reserve a seat on a journey

To reserve one or more Seats on a Journey, you must be a Member and have accepted these Terms and Conditions. An online seat reservation system has been set up for Trips offered on the Platform.

Any Passenger interested in a Carpooling Proposition on the Platform is free to book one or more Seats for the corresponding Trip, subject to the availability previously indicated by the Driver. At the time of booking, the Passenger must pay online the amount corresponding to the Driver's Contribution and the Platform's Service Fees, where applicable.

Once payment has been verified and validated, the Passenger who has made the Reservation receives a Reservation Confirmation by email, to the e-mail address given at the time of registration, containing all the terms and conditions of the Carpooling Trip.

Consequently, the Driver and Passengers remain solely responsible for the proper execution of the moral contract that the Reservation represents.

However, we would like to remind you that in the event of an explicit attempt to bypass the platform’s payment system, thereby encouraging you to go beyond the application, StadiumGO reserves the right, at its sole discretion, to delete or suspend your Account without prior notice.

3.2.1. Terms and conditions for booking a seat on behalf of a third party

Any use of one or more of the Services offered by the Platform is strictly nominative. Consequently, all Members, whether Drivers or Passengers, must correspond to the identity entered when registering on the Platform.

However, you still have the possibility to book one or more Seats on behalf of a third party for a journey, on the only condition that you agree to comply with the rules defined below:

accurately inform the Driver of the first name, age and contact details, if any, of the person for whom you are reserving one or more Seats on his or her Trip;

However, please note that it is strictly forbidden to reserve a Seat for a minor travelling alone on a Carpooling Trip. You can only reserve a seat for a minor in the context of a Carpooling Trip where he or she is accompanied by a parent or legal guardian.

In addition, please note that the Platform is strictly reserved for the reservation of Seats for human beings. It is therefore strictly forbidden to book a Seat for the transportation of an object, package, animal or any other material item. It is also forbidden to publish a Carpooling Proposition for a Driver other than yourself.

3.3 Terms of use of the Platform and its Services for non-commercial and non-professional purposes

By creating an Account on the Platform, you agree to use the Platform and all its Services only for non-commercial and non-professional purposes. As a Driver, and for any Trip published on the Platform, you undertake not to request a Contribution to Expenses greater than the actual costs incurred by the Trip. 

As this is a cost-sharing arrangement, it is therefore understood that, as a Driver, you are also required to bear your share of the costs relating to the Trip.

Although the Platform suggests a base price, detailed in article 5.1.1, you remain only responsible for calculating the actual costs of the Carpooling Trip, and therefore the amount charged to each Passenger. Consequently, it is your responsibility to ensure that this amount does not exceed the actual costs of the Trip, by referring in particular to the applicable flat-rate kilometer tax scale.

If you use the Platform and its Services with a professional vehicle such as a VTC, cab or company car, StadiumGO reserves the right to suspend or delete your Account. We remind you that it is strictly forbidden to profit and generate profit through Carpooling, and therefore, indirectly from the Platform.

Upon request by StadiumGO, you agree to provide any document that proves that you are authorised to use the vehicle on the Platform and do not derive any profit from it (vehicle registration document, etc.).

StadiumGO therefore reserves the right to suspend your Account, restrict access to the Services or terminate these GTU in the event of any activity on your part on the Platform that would result in a profit situation for you, or any reason whatsoever giving rise to suspicion that you are generating a profit on the Platform.

4. Ratings and opinions of Members

As part of the Platform's policy, StadiumGO strongly encourages you to leave a review for the Driver or Passenger with whom you have made a journey. Any review published on another Member's Profile will be visible to all Users. The same applies to notices you receive. However, as a Passenger, you cannot leave a review for another Passenger who has shared a trip with you.

4.1. Moderation of reviews

In the event that you do not leave a review for a Passenger or Driver, an automatic review "Good trip, I recommend!" associated with a maximum rating of 5 stars will be assigned to the Driver, so that he/she is not prejudiced.

StadiumGO reserves the right not to publish or to delete any review or comment whose content does not comply with these GTU.

StadiumGO reserves the right to suspend, limit access to or permanently delete your account in the event of a proliferation of negative reviews attesting to inappropriate behaviour that does not comply with these GTU.

5. Financial terms and payment management

Access to the Platform and all its services is entirely free of charge. 

Likewise, each User may freely search, consult and publish a Carpooling Proposition without paying any sum of money. Only the Reservation of one or more Seats is subject to a fee, and includes various charges detailed below.

The payment services present on the Platform and used by all Members to make a Reservation are provided by Stripe and are therefore subject to Stripe's General Terms and Conditions of Use. By accepting the present GTU, you also accept the conditions listed in the aforementioned contract, imposed by Stripe.

For each Member of the Platform, an associated Stripe Connected Account is created for the only and exclusive purpose of enabling them to store their funds, pending the transfer of amounts due to them to their bank account. This Connected Account is subject to Stripe's General Terms and Conditions of Use mentioned above, as well as to a Connected Account contract, which we invite you to read. Once again, by accepting the present Terms and Conditions, you indicate that you also accept this contract. 

This Connected Account does not appear on the Platform at any time, as all financial transactions take place only on the Platform.

5.1. Contribution to Fees and Collection

5.1.1. Definition of Contribution to Costs

For each publication of a Carpooling Proposition, a basic price is proposed. This price, calculated according to the nature of the journey and the distance, is adjustable by the Driver, who can lower it as he wishes, within a certain limit in order to avoid any abuse. Please note that it is strictly forbidden to make any profit from using the Platform.

For any Carpooling Trip, only the Driver is in a position to define the right amount of the Contribution to Expenses. Consequently, all Drivers undertake to limit as far as possible the amount of the Contribution to Expenses they ask their Passengers to pay to the costs actually incurred for the Carpooling Trip described in the Proposition. By reserving one or more Seats on a Trip, the Passenger agrees to pay the amount requested by the Driver.

5.1.2. Collection of the Contribution to Costs

Due to the use of Stripe as a payment module and the creation of a Connected Account for each Member, StadiumGO undertakes not to cash, at any time and under any circumstances, the sum paid by the Passenger, corresponding to the total amount of the Contribution to Costs and the Booking Costs relating to the Trip.

This sum, due to the Driver, is temporarily paid into his/her Connected Account, pending transfer to his/her bank account.

You nevertheless agree to respond to any request from StadiumGO or an administrative authority, in particular with regard to preventing and combating fraud. Consequently, you also agree to provide, if necessary, any proof of address or identity card required to identify you.

In the absence of a response to these requests, StadiumGO reserves the right to take appropriate measures, including freezing any sums paid or even suspending your account.

5.1.3. Payment of the Contribution to the Driver's Expenses

If no claim is made by the Passenger within 24 hours of the journey, StadiumGO will consider the validation of the Journey to have been completed. Once this period has elapsed, the Driver receives a credit on his/her Wallet, corresponding to the total amount paid by the Passenger at the time of his/her Reservation (minus the Reservation Fees retained by StadiumGO). Consequently, your credit is equal to the sum of the Fee Contribution paid by the Passenger.

Once the journey has been made, the transfer will be automatically ordered. It takes between 5 and 10 working days for the funds to appear in your bank account.

5.1.4. Limitation period

After a limitation period of 5 years, any amount that has not been claimed from StadiumGO will be considered to belong to StadiumGO.

5.2. Booking fees paid by the Passenger to StadiumGO

In consideration for the use of the Platform and Services made available by StadiumGO, the Passenger undertakes to pay Booking Fees.

It is hereby agreed that StadiumGO will deduct from each Passenger and for each Seat reserved, the sum corresponding to 13% of the price of the Trip, as defined by the Driver.

For any Proposition, regardless of the amount of the fee contribution, the booking fee shall in no case exceed 13% of the said amount.

You acknowledge and agree that StadiumGO may, at its own discretion, round down or up the Booking Fee and the Fee Contribution.

However, the minimum Reservation Fee is set at €1 (one euro) regardless of the amount of the journey.

6. Cancellation policy

In the case of a Carpooling Trip made by a Driver and resulting in one or more Reservations, cancellation and reimbursement are subject to a certain number of conditions, detailed below.

6.1. Refund conditions

6.1.1. Cancellation by the Driver

In the event of cancellation by the Driver, for any reason whatsoever and no matter how far in advance of the scheduled departure time explicitly indicated in the Proposition, the Passenger will be refunded in full the amount paid, i.e. the Contribution to Costs and the Booking Costs relating to the Trip.

6.1.2. Cancellation by the Passenger

If the Passenger cancels their booking, the refund terms vary according to certain criteria detailed below:

  • If the Passenger cancels more than 24 hours before the scheduled departure time explicitly indicated in the Proposition, the Passenger is refunded the full amount of the Fee Contribution. However, StadiumGO retains the Booking Fee, and the Driver will not receive any amount of money whatsoever;
  • If the Passenger cancels less than 24 hours or 24 hours before the scheduled departure time explicitly indicated in the Proposition, the Passenger will be refunded half of the Fee Contribution. However, StadiumGO retains the Booking Fee, and the Driver will receive half of the Fee Contribution paid by the Passenger at the time of Booking;
  • If the Passenger cancels after the scheduled departure time explicitly indicated in the Proposition, or does not arrive at the meeting point defined in the Proposition within 15 minutes after the agreed time, no refund will be made. The Driver will therefore be compensated by receiving the full amount of the Fee Contribution. The Reservation Fee will naturally be retained by StadiumGO.

In the event of cancellation by a Passenger prior to departure, the cancelled Carpooling Seats are immediately made available to other Platform Members, who may then book them online.

StadiumGO shall assess the legitimacy of any refund requests it receives at its own discretion, on the basis of the information available.

7. Rules of conduct and commitment of Users and Members on the Platform

You hereby agree to be only responsible for complying with the laws, regulations and other obligations applicable to the use of the Platform and its Services. All Members and Users of the Platform are required to behave in an irreproachable and appropriate manner towards other Members and Users.

7.1. Commitment of Users and Members

By using the Platform as a User, i.e. any person using the available Services without having first created an Account, you undertake in particular to :

  • not to make any comments, behave in any way or publish any content on the Platform that is defamatory, abusive, obscene, pornographic, vulgar, offensive, aggressive, inappropriate, violent, threatening, harassing, racist, xenophobic, sexually oriented, inciting hatred, violence, discrimination or hatred, encouraging illicit activities or the use of illegal substances or, more generally, contrary to the Platform's values;
  • not infringe StadiumGO's rights and image, in particular its intellectual property rights
  • not to contact another member of the Platform for any purpose other than defining the terms and conditions of the Carpooling together;
  • comply with current legislation, even when travelling in a cross-border country;
  • not to open more than one account on the Platform;
  • not to open an Account on the Platform in the name of a third party;
  • not to provide StadiumGO with any false, misleading or fraudulent information in connection with the creation of an Account;
  • comply with these GTU;

7.2. Commitment of Drivers

By using the Platform as a Driver, you undertake, in addition to the rules previously set out in article 7.1, to :

  • not to use the Platform for professional or commercial purposes;
  • use the Platform only for Carpooling to a Sporting or Cultural Event as defined in article 2;
  • not to attempt to bypass the Platform's online booking system, set up by StadiumGO, by trying to communicate your personal details (telephone number or e-mail address in particular) to another Member, with the aim of making the booking outside the Platform and not paying the Booking Fee;
  • not to accept or make any payment outside the Platform;
  • comply with all laws and regulations applicable to driving and to the vehicle, and in particular to have valid third-party insurance at the time of the Carpooling Trip;
  • use a vehicle that is in perfect working order, compliant with all applicable regulations and other legal provisions, and in particular with an up-to-date technical inspection at the time of the Journey;
  • be in possession of a valid driver’s licence;
  • not to take any risk whatsoever while driving, and not to take any product likely to impair your attention or your ability to drive safely;
  • check that your vehicle insurance covers Carpooling, and therefore that your Passengers, considered as third parties in your vehicle during the Trip, are covered by your insurance;
  • on request from StadiumGO or any Passenger on your Trip, provide any document attesting to your ability to use this vehicle as a Driver on the Platform (driver’s licence, insurance certificate, vehicle registration document, etc.);
  • publish Carpooling Propositions corresponding only to journeys actually envisaged;
  • Carry out the Carpooling Trip as explicitly described in the Propositions published on the Platform, and respect the times and places defined with the other Members;
  • not take more Passengers than the number of Seats indicated in the Carpooling Proposition published on the Platform;
  • immediately inform all your Passengers of any changes to the Carpooling Trip (place of departure, timetable, etc.) or of any impediment, if applicable;
  • not to publish any Carpooling Proposition relating to a vehicle of which you are not the owner or for which you do not have the necessary authorizations to use it for Carpooling purposes;
  • ensure that you are contactable, by telephone or via the Platform's messaging system, by your Passengers on the day of the Journey;
  • not generate any profits from the Platform;
  • guarantee that they have no medical contraindications to driving;
  • behave responsibly during the Carpooling Trip, in accordance with the rules and spirit of Carpooling;

7.3. Passenger commitment

By using the Platform as a Passenger, you undertake, in addition to the rules previously set out in article 7.1, to :

  • behave responsibly during the Carpooling Trip, so as not to disturb either the Driver's concentration or the peace and quiet of any other Passengers;
  • respect the Driver's vehicle, its cleanliness and the rules of preference defined on his or her Profile concerning food, music or whether or not he or she accepts smokers;
  • immediately inform the Driver of any changes to the Carpooling Trip (place of departure, timetable, etc.) or any impediment, if applicable;
  • on request from StadiumGO or the Driver of your Carpool, provide any document that can prove your identity;
  • not to transport any object, merchandise, substance or animal during a Carpooling Trip that could interfere with the Driver's driving and concentration, or whose possession or transport is contrary to current legal provisions;
  • ensure that you are contactable, by telephone or through the Platform's messaging system, by the Driver on the day of the Trip;

8. Account suspension, access restriction and termination

You may delete your Account at any time. To do so, simply go to "Delete my account" on the Profile page.

In the event of any breach by you of these GTU, in particular of your obligations as a Member mentioned in articles 4.3 and 8 above, StadiumGO reserves the right to :

  • terminate these GTU immediately and without notice; and/or
  • not publish or, as the case may be, delete any notice, Proposition, message, Reservation or any other content published by you on the Platform; and/or
  • restrict your access to and use of the Platform; and/or
  • temporarily or permanently suspend your Account or any of the Platform Services;

In the case where we must apply one or more of these measures with regard to your Account, you will be expressly notified at the e-mail address indicated when creating your Account, in order to allow you to give StadiumGO further explanations on the facts concerned. Furthermore, StadiumGO will decide, at its own discretion, whether or not to suspend the measures put in place.

9. Personal data

As part of your use of the Platform, StadiumGO may collect and process some of your personal data. By using the Platform, and as soon as you create an Account and become a Member, you agree to the processing of your personal data by StadiumGO in accordance with applicable law and the stipulations of our Privacy Policy, which may be consulted online.

10. Intellectual property rights

10.1. Content published by StadiumGO

StadiumGO is the sole owner of all intellectual property rights relating to the Services, the Platform and its content (in particular texts, images, drawings, logos, videos, sounds, data, graphics, etc.) as well as the software and databases ensuring their operation. This ownership of rights is valid on the Platform, the pages and social network accounts held by StadiumGO as well as in the various emails sent by StadiumGO.

It is therefore strictly forbidden to :

  • reproduce, modify, adapt, distribute or disseminate the Platform, the Services and their content, except as explicitly authorised by StadiumGO;
  • decompile or to proceed to reverse-engineering the Platform or the Services, subject to the exceptions provided for by applicable law;
  • extract or attempt to extract any data from the Platform;

10.2. Content published by a Member

By using the Platform and its services, the Member implicitly grants StadiumGO a non-exclusive licence to use the content and data provided. It is therefore assumed, by these GTU, that you authorise StadiumGO to disseminate this content for the purposes of communication or making available to the public the content of the Platform.

To this end, you authorise StadiumGO to reproduce, adapt and translate your content in the manner set out below:

  • StadiumGO is authorised to reproduce all or part of your content on any digital recording medium, and in particular on any server, hard disk, memory card, or any other equivalent medium, in any format and by any process, to the extent necessary for any storage, backup, transmission or downloading operation related to the operation of the Platform;
  • StadiumGO is authorised to adapt and translate your content and to reproduce all such adaptations on any digital medium, for the purpose of providing the Services in different languages. This right also includes the ability to modify, in compliance with your moral rights, the formatting of your content to comply with the Platform's graphic charter and/or to adapt it for publication on the Platform;

11. Role, operation and availability of the Platform

11.1. StadiumGO's role

StadiumGO, through its Platform, aims to put Members in contact with each other with a view to making a Carpooling Trip. To do this, Members can create and publish Propositions for Carpooling trips. The rest of the Members can freely consult these Propositions in order to find out about the terms and conditions of the Journey or, if applicable, directly reserve one or more Seats in the vehicle of the Member who posted the Proposition on the Platform.

By using the Platform and its Services, you agree to these Terms and Conditions and acknowledge that StadiumGO is not a party to any agreement between you and other Members. Consequently, StadiumGO has no control over the behaviour of its Members and users of the Platform.

StadiumGO does not own, supply or manage the vehicles associated with the Classifieds, nor does it offer Journeys on the Platform. It does not provide any transport services, its only role being to act as an intermediary between several Members wishing to make a Carpooling Trip.

During a Carpooling Trip, all Members, including Drivers and Passengers, act under their only and entire responsibility, in accordance with the provisions of the French Civil Code relating to the law of obligations and contractual civil liability, detailed in the articles available for consultation here.

StadiumGO accepts no liability for the following:

  • when the Driver provides erroneous information, in his Proposition or by any other means, relating to the Trip;
  • cancellation or modification of a Trip by a Member;
  • when a Member behaves inappropriately during, before or after the Trip;

11.2. Platform operation and availability

It is a condition of these GTU that StadiumGO will do its utmost to keep the Platform accessible 7 days a week, 24 hours a day. However, due to various maintenance operations, updates or breakdowns, access to the Platform may be temporarily suspended without prior notice.

StadiumGO reserves the right to modify or interrupt, at its sole discretion, on a temporary or permanent basis, access to the Platform or to any of its Services.

12. Modification of the GCU

StadiumGO may, for various reasons, modify these GTU in order to adapt and comply with any changes in regulations. Any modification of these GTU will be automatically published on the Platform with an indication of the date of the update before it comes into force. Each user must accept them in order to continue to use the Platform and its Services.

13. Applicable law, jurisdiction and disputes

These GTU are written in English and are governed by French law.

In the event of any dispute, we invite you to contact our teams immediately at contact@stadiumgo.fr in order to take the necessary steps.

A dispute resolution platform, set up by the European Commission, is also accessible at this address. Under the rules applicable to mediation, you are obliged to inform StadiumGO in writing of any dispute with a view to obtaining an amicable solution, prior to any request for mediation.

14. Carpooling Bonus

14.1 Description of the operation

As part of the regulations relating to energy saving certificates (CEE), StadiumGO and TotalEnergies Marketing France (a simplified joint stock company with capital of 390,553,839.00 Euros, whose registered office is at 562, avenue du parc de l'île, 92000 Nanterre, registered under number 531 680 445 with the Nanterre Trade and Companies Register), allow you to take part in an operation that entitles you to a Carpooling Bonus under the conditions set out in the decrees of September 26, 2022 amending the decree of December 22, 2014 defining standardised energy-saving operations and of December 2, 2022 creating a bonus for standardised operation sheets relating to carpooling as part of the energy-saving certificates scheme and the conditions below.

Provided you meet the conditions of the offer set out in article 14.2 below, TotalEnergies Marketing France offers you a cash bonus of 25 euros.

StadiumGO and/or TotalEnergies Marketing France reserve the right to modify, suspend or terminate this offer at any time, subject to notifying you.

14.2. Conditions for benefiting from the operation

The Carpooling Reward of 25 euros is valid until December 31, 2025.

You may benefit from this offer only once, and only if you meet all of the following conditions:

(i) you are registered on the www.stadiumgo.fr website;

(ii) you hold a valid driver’s licence in France;

(iii) you have published, as a Driver, an Proposition for a Trip with Reservation for a distance greater than 80 km in France, for which at least the point of departure or the point of arrival is located in France;

(iv) you have made all or part of the Trip with a Passenger (whom you did not know prior to the Trip) who has paid the Participation Fee via the Platform;

(v) you have entered your postal address in France on your profile;

(vi) you have entered your cell phone number on your profile;

(vii) you have entered your driving licence number on your profile. Please note that your first and last names must be entered in the same way as they appear on your driver's licence in order to verify your driver's licence and eligibility;

(viii) you have completed your bank details and received payment of the Participation aux Frais;

(ix) you have accepted the terms and conditions of the Carpooling Reward offer, including these Terms and Conditions and the Privacy Policy;

(x) you have completed and signed the online attestation required under the aforementioned regulations; and

(xi) by January 1, 2023, you have not benefited from any incentive scheme under the energy-saving certificate program, or within twelve years of your journey if it is made after January 1, 2023.

(xii) you have connected your StadiumGO account and/or registered via FranceConnect

(xiii) you have read form TRA-SE-114

All these conditions must be met within a maximum of 8 months from the date of the first Journey made using the Platform's online booking service, and before December 31, 2025. After this deadline, you lose all entitlement to the Carpooling Bonus.

The Carpooling Bonus is paid to you in the form of a bank transfer, provided you have filled in your bank details on your profile.

14.3. Checking compliance with the terms and conditions of the operation

The provisions relating to the CEE offer are applicable only once per Driver. You agree to respond promptly to any request from StadiumGO to check compliance with this condition.

In the absence of a satisfactory response to such requests, StadiumGO reserves the right to take any appropriate action against you, including suspending your Account, limiting your access to the Services or terminating these GTU.

In addition, as part of the regulations relating to energy saving certificates, you may be contacted by TotalEnergies Marketing France, in particular regarding the trips contained in your file.

Finally, additional information and data may be requested via our intermediary from the bodies responsible for monitoring CEEs, in particular the Pôle National des Certificats d'Economie d'Energie. ;
